Welcome to the COSMO-Cost Modeler Mobile App ("App"). The App is developed and operated by Nomitech Ltd. ("Company," "we," "us," or "our"). By using the App, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you use the App on behalf of an entity, you represent that you have the authority to accept these Terms on behalf of that entity.

2. Description of Services

The App connects with the COSMO-Cost Modeler Web Application to provide project benchmarking and cost modeling features. Your use of the Web Application is governed by a separate agreement.

3. User Accounts

• You must create an account to use certain features of the App.

• You are responsible for maintaining the confidentiality of your login credentials.

• We reserve the right to suspend or terminate accounts for any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the App for unlawful purposes.

• Reverse-engineer, decompile, or modify any part of the App.

• Interfere with the App’s security features or other users’ access.

5. Intellectual Property

All content, trademarks, and intellectual property within the App are owned by Nomitech Ltd. You may not use our branding or proprietary information without permission.

6. Fees & Subscriptions

If applicable, subscription fees are non-refundable except as required by law. Any changes in pricing will be communicated in advance.

7. Disclaimers & Limitation of Liability

• The App is provided "as is" without warranties of any kind.

• Nomitech Ltd. is not responsible for any errors, data loss, or financial loss arising from the use of the App.

• To the fullest extent permitted by law, Nomitech Ltd. shall not be liable for any indirect, incidental, or consequential damages.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time for violations of these Terms.

9. Governing Law

This Agreement shall be governed by the laws of The Hellenic Republic (Greece). Any disputes shall be resolved through arbitration in the Courts of Greece.

End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is between you and Nomitech Ltd. and governs your use of the COSMO-Cost Modeler Mobile App.

1. License Grant

Nomitech Ltd. grants you a non-exclusive, non-transferable, revocable license to use the App strictly in accordance with this Agreement.

2. Restrictions

You agree not to:

• Copy, modify, or distribute the App.

• Reverse-engineer or attempt to extract the source code.

• Use the App for illegal purposes.

3. Ownership

The App is licensed, not sold. Nomitech Ltd. retains all ownership rights.

4. Warranty Disclaimer

The App is provided "as is," without any warranties. We make no guarantees about performance, availability, or suitability for a specific purpose.

5. Limitation of Liability

To the maximum extent permitted by law, Nomitech Ltd. is not liable for:

• Any direct, indirect, incidental, or consequential damages.

• Loss of data, profits, or business interruptions.

• Security breaches or unauthorized access.

6. Termination

We may terminate this Agreement if you fail to comply with its terms. Upon termination, you must stop using the App.
